1. Acceptance of Terms
By accessing or using the Crown Capital Funding platform located at crowncapitalfunding.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. Crown Capital Funding reserves the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
2. Eligibility
To use the Platform and apply for funding, you must: (a) be at least 18 years of age; (b) be a Canadian or United States resident operating a legitimate business; (c) have authority to bind your business to these Terms; and (d) provide accurate, complete, and current information during the application process.
3. Funding Products and Services
Crown Capital Funding acts as a funding broker and capital solutions provider. We offer Merchant Cash Advances, term loans, lines of credit, equipment financing, and other business funding products. Crown Capital Funding does not guarantee approval of any application. All funding decisions are subject to underwriting review, creditworthiness assessment, and applicable lending criteria. Funding amounts, rates, and terms vary based on individual business qualifications.
4. Application and Information Accuracy
By submitting a funding application, you certify that all information provided — including business details, financial information, personal identification, and supporting documents — is true, accurate, complete, and not misleading. You authorize Crown Capital Funding and its partners, agents, and affiliates to verify the information provided, conduct soft and hard credit inquiries as required, contact third parties including landlords, suppliers, and financial institutions, and share your information with funding partners and lenders for the purpose of evaluating your application.
5. Merchant Cash Advance Terms
A Merchant Cash Advance (MCA) is not a loan. It is a purchase of a portion of your future business receivables. MCA agreements are governed by a separate Merchant Agreement which will be provided upon approval. By submitting an MCA application you acknowledge that: repayment is tied to your business revenue; factor rates and holdback percentages apply as disclosed in your Merchant Agreement; early repayment may not reduce total cost; and MCAs are business-to-business transactions not subject to consumer lending regulations.
6. Privacy and Data Use
Your use of the Platform is also governed by our Privacy Policy, incorporated into these Terms by reference. By using the Platform you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
7. Credit Inquiries
By submitting an application, you authorize Crown Capital Funding to obtain consumer and commercial credit reports from Equifax, TransUnion, Dun & Bradstreet, and other reporting agencies. Soft credit checks do not affect your credit score. Hard credit inquiries, which may occur during final underwriting, may affect your credit score and will be disclosed prior to being conducted.
8. Fees
Crown Capital Funding does not charge upfront application fees. Fees associated with funding products, including origination fees, broker fees, and factor rates, will be disclosed in full prior to signing any agreement. You are not obligated to accept any offer.
9. Platform Use and Restrictions
You agree not to: (a) use the Platform for any unlawful purpose; (b) submit false or misleading information; (c) attempt to gain unauthorized access to any part of the Platform; (d) interfere with the operation of the Platform; or (e) use the Platform to engage in fraudulent activity. Crown Capital Funding reserves the right to suspend or terminate access at any time for violations of these Terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Crown Capital Funding and its directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any funding product. Our total liability in any matter related to these Terms shall not exceed the fees paid by you to Crown Capital Funding in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Crown Capital Funding, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your provision of inaccurate information.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
